During a relationship I co-signed for a student loan. This isn't the important part yet but it will come to play later. Right around the end of the relationship the ex wanted to trade in her car and get something newer. Me not being so smart I agreed to help her out. The deal was that I would help her co-sign for a loan and in 3 months we would try to get my name off the loan completely. Well it turned out her credit wasn't too good and they wouldn't give her any loan with her name on it. So I was the only signer of the loan. Stupid me again, I know. The deal was the same as above. She was to pay for the car and the insurance until her credit was good enough and she was at her job long enough to take it over.
My luck would have it that she would get fired from her job and have no income. No income, no loan. Her mother was able to help her pay it until she got another job. Months gone by she misses a payment and I have to pay it. I tell her I want the car returned. She goes out and races it the night before at the track and leaves it in my driveway later that night with the keys on the seat.
A couple days go by and she calls me crying her eyes out that she wants it back and she would pay me for the missed payment. She tells me that she will pay it and not miss any payments. Me being stupid again I agree. She takes the car back.
Months go by again and I receive a call that she missed 2 payments. I call her and she tells me they screwed up, then she tells me her mom forgot to send it, and finally I find out that she sent a check and it bounced. I pay 2 more payments. She agrees to send me a check to make up for the missed payments again. She never does. Another 2 months go by and she misses those 2 months again. This time I tell her I'm coming to get the car. She tells me the car has been impounded and has a boot on it. She tells me it was parked in a college parking lot and she had a fake parking pass. So I have to drive 3 hours one way to get it and pay the tickets to get it out. The tickets are over $200. We come to an agreement that she pays me the 4 missed payments, the $200 for the tickets, and the extra that was on the loan for her trade. She tells me she has a check from work for over $4,000 dollars that I can have. We both agree that I come get the car and check and we call it even.
I go get the car and check which she signed. I get all the way back home and deposit the check to make sure it clears first before using any of it on the loan. Well it turns out the check comes back insufficient funds. The check is a fake check. It turns out she knew it was fake.
Plus I have a student loan signed with her. She is destroying my credit. What can I do next? Do I have a case? I have tons of instant messages saying exactly what we agreed on. Does this count as a verbal agreement?
