Divorce in Texas and Possibly a Civil Action

I am recently separated from a spouse (married 5 yrs) who has spent the last 2 years in another state going to school to become a Physician's Assistant- . He has now returned home and has decided he does not want to be married anymore. He could not work while at school (he borrowed money to attend school/live in the other state. For the last 2 years I held down the homefront financially and paid for his car note, credit card bills, etc.. I feel used. I have retained an attorney who basically tells me since I make good money and am educated that the judge will just divide up the assets and debt 50/50 and if I wanted to I could take him to court for a civil action. I know he would not have received his degree without my financial and emotional support- I am entitled to reimbursement financially in either family or civil court- if so which do I do first- we have no children. Please advise- thank you
