I am trying to file for my own divorce in the state of New York, in the county of Queens. I am trying to divorce on the grounds of a Serparation agreement ( it was signed & notorized back in april 2007 IN NEW YORK by both of us) (I did not take it to the county clerk because i did not know i was suppose to take it there.) can i take it there now & start the divorce? THE NEW YORK DIVORCE KIT MENTIONED THAT:
(b) that the agreement / memorandum of said agreement was filed on
in the Office of the Clerk of the County of , wherein Plaintiff / Defendant
resided; and
Also MY HUSBAND LIVES IN MEMPHIS, TN AND HE WILL BE VISITING NEW YORK THIS WEEK, AFTERWARDS HE WILL LEAVE THE COUNTRY FOR 2 1/2 MONTHS. CAN I HAVE HIM FILL OUT ALL THE PAPAR WORK AND AFFIDAVITS WHILE HE IS HERE?
