My jurisdiction is: MS court, LA resident
My daughter after four years finally found a newspaper announcement where her husband (she thought the marriage was annulled) is suing for divorce and custody (he had refused to put his name on the BC at the time of birth -they were not married at the time). I can not afford a lawyer and legal services said she makes too much money to qualify for assistance so I will try to face the judge with my daughter. My grandson just turned six years old two days ago and I would like to know what I need in order to better prepare myself in court. If her friend will testify to the fact that they falsely accused me of assault I can prove that they are not credible and the duration of the marriage prior to the separation my sister can witness that she never did commit adultery or habitual inhumane treatment as stated in the served papers, in fact, prior to the marriage he tried to isolate her from everyone once he found out that she was pregnant. She with the help of my sister, got the baby and moved to LA and was going to try to establish residency there and start a life, he filed a lawsuit for custody. He talked her into getting back together, moved to LA (which he did not state in the papers), started a business and married her. Five months later he took the baby to see his parents and came back without the baby and papers for everything in the store. I had exhausted my finances and was longer able to help monetarily. I tried to visit Isaac, the father, and the baby for his 2nd birthday - they asked me several times if I was alone and that's when his mother (60 yrs old)grabbed my arm and told me that I tried to assault her, I was taken aback and two minutes later the police showed up, someone else in the house had called the police. My daughter's friend was there at the time and can verify my accounts if he so chooses. I had to go to the police station and I believe the Chief of Police believed my story but said he was unable to do anything and that I would have to get a lawyer to see my grandson. The grandmother has stated to me that she wished my daughter would just go away and leave them to raise the baby in a non-medical way, no vaccines or doctors. We were unable to find them for quite some time so when her friend mailed us the notice in the MS paper we tried to get legal aid but was denied so I am just trying to make sure I have all my t's crossed and i's dotted before I enter the courtroom. He also want her to pay for his legal fees and is demanding supervised visits even though he is the one I would not trust to give the baby back at the time of visitation switch. Any help would be very much appreciated. I know this is an uphill battle but it is one we must face.
