Dispute with neighbor over tree limbs

Hello -

Our next door neighbor has tree limbs extending over our deck. We've written him notes and spoken to him in person, asking that he either remove his tree completely or at least trim the branches back to the property line between our houses.

He keeps stating he will, but it's been a few months and we're out of patience, as his tree continues to grow.

Can we obtain bids ourselves from tree trimmers, have the branches trimmed, then send him the bill for reimbursement?

If he does not pay us back, then take him to small claims court??

FN: As an aside, I last spoke with him regarding this issue on 9/24/07. During the past week, he's started parking his truck directly in front of our house (we live next door to him on a cul-de-sac), making it difficult to remove mail from our mailbox. His driveway is available and that's were he usually parks until recently. I believe he is doing this as a retaliatory means.
