Where do I find when a motion for dismissal can be submitted with prejudice and when a motion for dismissal can be submitted without prejudice? There must be some rules somewhere but I can't find them in the state code or court rules. Any idea on where to look? I live in Washington state.

Well, it would be under the Washington Rules of Civil Procedure.

You motion to dismiss before you respond to anything else. If you have answered the complaint, the motion is moot.

Anytime you motion the court for a dismisal, you always ask that it be dismissed with prejudice so they don't refile.

In any action, criminal or civil, if no motion to dismiss was filed, that is nothing less than complete negligence. Challange SMJ, and motion to dismiss, Demure if your state allows.
