My son's father left him when he was 3 years old and has had no contact with him in 7 years. He is now ten years old. Last year I filed for full legal and physical custody of my son and was awarded it. His father is now a drug addict, with no job and nothing to show for. He also had numerous kids with another drug addict and has had them legally taken away by the state. He is currently homeless and unable to track down.

My question is I have now remarried and my husband want to adopt my son. With money being tight, what is the quickest, cheapest way to start this procedure? I know for a fact that his biological father will not put up a fight.

My second question is once the adoption papers are in...how do I go about changing his last name to mine and my husbands?

You are best to work through an Attorney to do this. You will first need to show Dad has abandoned children that shouldnt be too hard. Then you can seek a TPR which is a Termination of Parental Rights. At same tiem you can begin the adoption process. None of this is going to go quickly it will take close to a year. You could attempt this on your own but any mistakes will only delay process so again I advise you do this through a Lawyer
