I work for the goverment and have been on lwop (Leave Without Pay) since 1/30/2007, I recieved notice from employer today that i should consider fmla or disability retirement..my union is useless(Good Friends with management). Arent they required to provide the LWOP unitll i am out 1 year to be eligible to apply for disability retirement since they do not provide any disability benefits? or can they make me apply? I have mrsa its very contageous and they are advising me to apply for fmla or dbl retirement...or come back to work...in my letter they advised me if i did not apply for dbl retirement they would begin the paperwork to have me removed from the service??Can they Do This?
