My Wireless Service Agreement reads the following:
"All phone returns are only eligible for a refund if they are returned within 30 days of the original invoice and/or activation date".
Phones were purchased on February 25, 2008. I attempted to return them on March 26,2008, however the Seller refused to accept them saying that the return policy had already expired.
My understanding was that the first day (24 hours) ended on 2/26, second day ended on 2/27 and so on, with the 30th day ending on 3/26.
According to the Seller, first day was the day of the purchase - 2/25, second day was 2/26 and so on with the last day ending on 3/25.
Can you please advise what is the right way to calculate 30 days from the date of the purchase and if there is a legal definition of the "within 30 days" term. Agreement doesn't provide any explanation of how days would be calculated, so there should be a standard procedure accepted by the law.
Thank you!
