I live in NY with a domestic partner. We own a home jointly 50/50. This is a single family home where we live as our primary residence. There is no mortgage on the property. Our deed states us as 'joint tenants'. We are wondering if it is necessary for the words 'with right of survivorship' to follow joint tenants on our deed. Does this make a difference? In the event of death of one co-owner we would like the entire property to be deeded to the surviving partner without the risk of probate.

If we do need to file a new deed, what is the procedure? What type of deed is best?

Many thanks for your thoughts on this.

Joint tenancy: A single estate in land owned by 2 or more persons created under one instrument at one time. When one joint tenant dies, the entire property goes to the surviving tenant(s).
