I'm being sued by portfolio recovery in Texas. My question is do I file a general response or can I filed a motion to dismissed on the grounds that the petitioner did not included in the petition the required signed contract with the original creditor. Also, I believe the statute of limitation has already expired.

If the SOL has run, then that's all you need to defend. Make sure you note SOL in your response. Make sure you don't default.
