I bought a car for my daughter as a graduation present, I had a trade in that owed money, I took with me a statement of my trade in with the balance, they took the statement and came back and told us what the actual pay off was, we all made an agreement and all papers to the deal were signed, three days later they are now saying they made a mistake and that the amount of the trade in owed was more than what they had stated. We have two vehicles financed by the same bank so when the searched for the pay off they got my other vehicle's pay off not my trade in. Now they need us to come up with 3,500 more, or return the vehicle after we gave it as a present.
Can I sue them?

However, what would be the legal theory under which you propose bringing your law suit?

I suggest you read ALL of the documents you signed.

During that assignment look for and note the "weasel words".
