Daughter out of state on vacation with grandma how can I file for custody with mother

My daughter is out of state on vacation visiting grandma. The mother and I broke up recently and she has said on numerous occasions she does not want our daughter because she doesn't feel is a good mother and she is an alcoholic. I am planning to relocate soon from northern california to southern california. Is it best I file for custody here where we reside now or wait until I move? Also if she has stated she does not want our daughter what do I do in that situation? I just don't want her to come back later and say I kidnapped my daughter or decide she wants our daughter back in her life.
 
Was paternity established? If it has been then in most states you have just as many rights as the mother. Because you plan on moving a good distance with the child you should file for custody in N CA and ask for permission to move. Keep in mind that you'll probably be on the hook fror transportation for visits since you are the one creating the distance. There is no guarantee you'll get custody if mom also asks for it. Your impending move may give you some difficulties.

Why are you moving?Be prepared to prove its in the childs best interest.
