My jurisdiction is: Alabama
Last week, I was arrested for attempted possesion of a controlled substance, Lortabs. I was taken into custody, but posted bond the next day. My live-in off and on again boyfriend of 5 years took our daughter. She turned 1 on June 12, 2008. We were living together up until I was arrested. When I was released, I tried calling his cell and our home, no answer. I didn't hear from him regarding my daughter for 5 days. His name is on the birth certificate, but paternity has never been established and there has never been a child support order. She was actually born in the state of Florida because he kicked me out while I was pregnant and I lived with my grandparents. He has allowed me to see her 3 times in the last two week under his terms, at his mothers house or his grandparents house. He will not allow me to leave with her nor drop her off at my house. I can't be alone with her. He said I will never get her back and that I will have to pay him child support. What can I do?? I want my baby back!! I have been her primary care taker for the last year since after she was born and we got back together, we agreed I would be a stay at home mommy for the first year then I would put my Associates Degree in Dental Assisting to use. The car I have he has taken from me, it was purchased after I graduated college and it is in both our names. I have no transportation and am now living back with my parents because of my arrest. What can I do?? I want and need my baby back!! I have not been convicited of my crime, I do not go to court until August. I am trying to do this the right way so that my daughter is not bounced back and forth! I am trying not to make waves because I am in enough trouble. I think I have posted everything to do with this situtation! What can I do?? I have done as the DEA, detectives, and TASC have instructed and they so far have assured me that I have done the right thing! Can he take my baby from me?? Help....please!!
