My ex husband and I separated in 2004. He moved to california and when my son was visiting him in 2005 he filed for custody and divorce. He was granted the custody due to the fact I did not have the money to fly out there. He kept my son for a year and since 2006 my son has been back at home with me. I can not file for custody out here due to the fact California has jurisdiction. Does my ex still have legal custody over my son even though he has been living with me since then and if so how can I get jurisdiction out here. Legal Aide will not help me due to the jurisdiction and I dont have tons of money to get this handled. This probably does not mean anything but my ex does not pay child support. Also my son does not want to go and visit this summer and I am worried my ex might try to fight me on this.
