custody issues with my fiances 2 children

My fiance wants to get custody of his one year old son and his 1 1/2 month old daughter. We had the son up untill the 27th of october at which time the mother was able to get a parte interim order to get the child back. In the papers we received it states that he had both children at the time. Is there any way that she could get into trouble for lieing to the judge about having both children when he only had the one? Also the order states that he is allowed visitation with the children with a person that they agree on, but she has changed the home number where she is living and will not answer her cell phone. Is she in contempt of court by not allowing him to contact her to set up a time to come visit the children?

Also he has 10 days to respond to the court in regaurds to the order so how does he go about petitioning the order without a lawyer because we cannot afford one.

The mother of the children has a prior abuse/neglect charge that she was found guilty on that had to do with her oldest child who is not the child of my fiance and we do not think she is capable of taking care of the three children she has. What would you advise us to do as far as getting custody because we cannot find a lawyer and legal assistance wont help us because they are already helping her.
 
Dad needs to go down to the courts and start researching civil procedure and file for custody. He needs to prove that mom is unfit. At the bare mimimum he should file for joint custody and specific set, frequent visitation. If I were him, google some fathers rights groups for help.

Who is the father of the oldest? Is your fiancee the legal father? If not is he able to track down the real bio dad and let him know what is going on and that he should some how get involved and file for custody?

No my fiancee is not the legal father, and yes he does know who the father is but he doesnt have anyway to contact him. We did google some fathers rights groups and that didnt help much we kinda just got the go around.
