Custody Issue w/ my son.

Ok, here is the story and I need advice! I am a single father, who resides in another state than my son. My son is 3 months old, and lives with his mother and her husband. They were married after he was born ( just days) but her husband( at that time her boyfriend) signed my son's birth certificate. I am sure once paternity is established it wil prove I am the father. But she lives out of state and will not speak to me. I have only seen my son a few times and really have no proof that we have established any type of bonding/relationship. Her husband has been acting as his father in my place. She will not work things out with me so I have to do things legally. the only drawback is I have a couple of things in my history DUI and a non-violent felony, and a sexually related misdemeanor. ( which one day i plan to expunge, does that make adifference?) I dont want to go into this blind, but i know things are not really on my side. i need advice, please help me
 
First things first you need to dispute paternity ASAP and you probably need to see an attorney in the state where the child resides. The fact you live out of state and have a not so great history and a sexual offense( which by the way I doubt can be expunged) you may get very little rights to the baby. If this guy signed the birth cert. or was married to the woman when she delivered, he is the legal father and you have a very short time frame to request a paternity test.

I guess decide how much you want to fight and get pushed away from the mother.
