Custody in Alabama

I recently separated from my girlfriend that I lived with for several years. When our children were born, I signed the birth certificates and the affidavits of paternity. The children are currently with me. No custody or visitation has previously been agreed upon or entered by any court. I need to know if anyone can legally come take the children from me without a court order because their mother is trying to and its not in their best interest. I have contacted an attorney but cannot pay the filing fees today.

Until a court decides otherwise either of you have full rights to the kids. Borrow the money to file for custody ASAP.
