custody/guardianship of a minor

My sister-in-law wants to give my husband and I custody of her 9-year-old son so he can live with us and go to school in the U.S. She is a Mexican citizen living in Mexico. He is a U.S. born citizen living in Mexico with her. She never married his father, and he is nowhere to be found. I'm unsure which guardianship petition to submit and unsure of whether or not that's the route to take. Would we need to adopt him? Does anyone have any experience with this kind of case? She is willing to give us full custody, but she cannot come to the U.S. to attend a court hearing. Thanks in advance for any advice you may have to help me out. :)
 
You need to consult an attorney.

It may be that your SIL can transfer custody or guardianship in Mexico. Those orders should be recognized in the US. You do need to check with an attorney though.
