Custody for a spouse moving out-of-state

My husband and I are discussing separation/divorce. His family lives in the area but my family live in other states. We have previously talked about moving (prior to the separation discussion) and I want to move closer to my family. I have applied for jobs down south to be closer to my family, but my husband adamently refuses to consider moving now stating he never wanted to move to begin with. If I were offered a job and accept it, it would require that I move to another state while he would more than likely stay where he's at. What are my rights to be able to take our 10 month old with me? My husband doesn't seem to take care of the baby, he can't be left alone with her at night because he can't hear her when she wakes up, he wouldn't be able to support her financially and at times he can have a temper.
 
You will need either your husband's permission, or permission from the court, to relocate the child.
 
You still chose him to father your child he is Dad and he has rights. You will have to battle it out in court. Can you financially support the child seems like you do not have a job either? Either you make Dad a SWEET deal to get him to agree to the move lor you have to go to court and it is possible you will not be able to take the child. How is he ever going to see the baby?
