I have sole custody of 3 children from a previous marriage, ages 13, 12 & 10.
My ex-wife, my children's birth mother, lives in Kansas more than 5 hours from our home. She refuses to move closer to the children & when they're able to get ahold of her on the phone (she very seldom ever calls them), she's too busy complaining about having to pay child support to hear what the kids are telling her. When they ask her to repeat what they just told her, she can't. She never sends the kids letters, cards or e-mails.
My children's birth mother has a long history of illegal drug use (methamphetamine & cocaine are her drugs of choice), a horrendous temper that my children are most often the victims of during her court ordered visitation (the judge has to force her to visit the kids or she refuses) & her temper has seen by the judge in District Court and by the judge in County Court. She's paranoid & dillusional (side affect from the illegal drugs) and has a long history of committing the crimes of shoplifting, stealing checks, forgery, contributing to the deliquency of a child, prostitution for drugs, soliciting a cop, and numerous other crimes.
My current wife & I have been renting our current home for the past several years. We moved here temporarily so I could have my medical problems treated by the physicians in Lincoln, NE which are better doctors than in our home state. Since then, because of the Nebraska law that requires a custodial parent to get permission of the court to move to another state, we've been stuck here unable to move back home because we can't find an attorney to take our case.
We've called every attorney in the Lincoln, Nebraska phone book from Lincoln, Omaha & surrounding areas. We've been told that they either don't do these kind of cases or they require a retainer fee up front which is the exact amount of my Social Security retirement check on the 3rd of the month. We have bills to pay on the 3rd of the month & groceries to buy.
The home that we've been renting which is literally caving in ... the roof is falling in & leaks all over, the foundation walls are caving in & leaks, there's horrendous smelling black mold covering the walls that literally makes my wife very sick from the smell, the floor joices are rotting, the subfloors are rotting. there are 3 substantial sized holes in the floors, the floors literally bounce when we walk on them, the feet on the bottom of our appliances are now completely through the floors, our furnace doesn't work at all & a plumber told us that it's too old to be repaired, it needs to be replaced; our hot water heater doesn't work at all & a plumber told us it's too old to be repaired, it needs to be replaced; we don't have any water because our well went dry according to a plumber, and much more. Our home is definately not safe.
Our landlord refuses to pay the cost for any of the necessary repairs and refuses to replace our furnace, hot water heater or dig a new well. This is very clearly a violation of the Nebraska Uniform Landlord & Tenant Act #76-1419 (landord to maintain fit premises).
We can't afford to rent a different home in our county ... rent is much too high. The Nebraska Department of Health & Human Services won't let us move into a 2 bedroom home or apartment because it's much too small for our family. We can't afford to buy a home in this state because the asking prices are much too high as are the property taxes.
We need to move to our home state to the home that we own as soon as is humanly possible, while we still have a home left standing to move out of.
Is there a loophole that we can get around the law requiring that a custodial parent get permission from the courts to move? If not, how can we get our case in front of a judge without being able to find an attorney to take our case?
