CPS and DWI

Hello, we are trying to adopt and have found out that CPS bases there background checks on arrest records. We were recently denied due to an arrest for DWI. We were not charged with DWI but with obstruction of passage way. We were denied due the DWI arrest. What happened to innocent until proven guilty? Can we do anything about this situation?

Not much you can do about the way CPS screens for adoptions, although it wouldn't hurt to consult an attorney.

You might want to post this in the Criminal Law forum to see if anyone knows whether or not the arrest can be expunged. If you do post there, include the name of your state.
