court order for custody

Hi, I have never did this before but I am sure needing some advice as where to turn to. I am a step mother--no not one of those whicked step mothers--I do alot for my stepchildren. The problem is my spouse or the father of these children is in jail for Drinking and Driving. The mother of these children which are age 9 and 11 has been on welfare since the children were born--she doesnt work or provide for the children, she has issues of drugs and just plain laziness-just one of those mothers that you wonder how God blessed her. I know I dont really have any rights to the children as just a step mother but I feel so bad for them. The court order states that the children are shared 50/50 custody; well with my spouse in jail the bio mom is playing games and not letting me take the children as the court order states. My husband is telling me to let her know that he checked into with officers in jail that if she doesnt comply it is considered kidnapping. Does anyone have any advice for me? The worse thing is no matter what steps I take--the only ones suffering are the children.
