I Have Been Hospitalized On Three Occasions Since The Year Began.* I Was Already Being Treated For Mild Asthma, But Since Moving To This House Two Years Ago, I Have Gone From Mild To Chronic.* My New Diagnoisis Is Chronic Obstructive Pulmonary Disease (copd) And Now My Asthma Is Rated "severe".* How Can I Hold The Landlord Liable For The Rapid Decline In My Health Which I Believe Began Last Summer With A Water Leak On The Carpet And Subsequently Producing Mold Spores.* I Have Not Had This Verified.* Do I Have Any Legal Recourse?

I am now using oxygen full-time at home.

Do you do anything to contribute to the diagnosis, like smoking? You have to be able to prove that there is a mold problem, how do you know there is a mold problem that is causing this? Unless the mold issue has been documented in your medical records there's probably not much to go on. Especially if you have bad habits that contribute to the COPD (COPD is most commonly caused from smoking or a history of smoking, even being around second hand smoke). I'm only asking because these are things that COULD hurt your claim if you were able to make one.
