Consent of Adoption from state to state

We live in MI and are working with a birth-mom in CA. The match was going great. She called us and told us that her water broke. We went out to CA ASAP and missed the birth by 5mins. After the birth our case worker told use that the birth-mom was doing drugs. Therefore, the baby (boy) has been in the NICU and we have been by his side ever since birth. She signed all rights over to us right after birth. But one thing, we are doing a California consent so an evaluation needs to be done on her before we can move on. The only thing with that is ever since she gave birth she has been on a drug binge and is refusing to have the evaluation. Can we change and do a MI consent will make a difference?? or please give us some advice on what to do. I love this little boy so much and he needs a good home. We don't want him to go to a foster home. PLEASE HELP! any advice??

You need an attorney. Adoption is complicated enough within a single state. By matching with an out of state birthmother, the Interstate Compact on the Placement of Children must be followed. http://icpc.aphsa.org/Home/home_news.asp

There are procedures if birthmom has vanished. It will be far cheaper in the long run to hire an attorney who specializes in adoption (and has experience with ICPC).
