I need some advice or help. This is a pretty big situation/problem. The situation is as follows: My husband divorced his ex wife due to emotional abuse from her. She is german and my husband is a soldier in the US Army. They have joint custody of the 2 minor children. (daughter is 13 and son is 6). His ex would only agree to the terms of the divorce if my husband would allow her to return to Germany with the kids. My husband did agree with her leaving as long as she agreed and signed the divorce degree and the custody paperwork. The custody agreement was that Tom was to know the address and phone of where the kids were at at all times, and be able to talk with his children at anytime. He was to get them for every other holiday and 2 months out of the summer. And the big one was that if his 13 year old daughter wanted to live with him she could. All she had to do was move to germany with her mother and than after 3 months if she chose to come back to the states she could. My husband also owned a house that the kids and his ex were living in. He was order to sell the house and split any of the profits with his ex. He was also order to sell the 1999 Jeep Grand Cherekee that he own and was to give his ex all the profits from the sell. The child support is not that much, and we have no problem paying it. But once Tom's ex recieved the passport for the 6 year child and the divorce paperwork she took off to germany. My husband was suppose to have visitation with the kids the weekend before they were scheduled to leave. He even purchased the air plane tickets for the kids. But his ex left the friday before the visitation. So my husband did not even get a chance to say good-bye. When he went to his house he found out that she had completey vandelized it. Paint was all over the carpet and the furniture. She had written all over the walls in black marker in german, cut all the electrical cords to all the appliances (fridge, w/d, dishwasher etc..) basically she destroyed the house. And she had put my husband jeep into at lake. Needless to say it has cost my husband close to 35000.00 to get the house ready to sell and to get the jeep to where is can be sold, for a very small profit. THe closing on the house is of this month a whole 2 years after the divorce.
When Tom's ex left she did not leave in information reguarding to where my husband was to send the child support. So he opened an account and has been sending money there every month. My husband would get random emails from his ex demanding money, but never leaving any information on where to send it. After about 15 months of waiting my husband finally received an email stating that he has not been paying support and that the German goverment was getting involved. We have all the money that he was suppost to send her in an account with the kids name on it. With proof of the monthly deposits since the day they left. What I need to know is what can we do legally to enforce the visitation rights that my husband had order by the judge. The divorce decree/parenting plan states that they have joint custody. Yet she has keep the kids completely away from my husband for a total of 16 months. What can we do?
