Hello, I'm new to this forum...I have a question regarding who is at fault in my particular case. Any sound legal help would be appreciated. Thanks in adavance. Here is the situation:

I went to an auto repair shop and I parked in front of the office entrance since there were no parking spaces available at the time. Came back out and got into my car and started the car that's when a mechanic was backing out a car and hit my driver side door. Insurance was filed and damage was appraised, the claim handler told me that it would be a 50/50 split. They accused me of parking in a no parking zone, which I said that I was unaware of it. Am I at fault in this situation? I was inside my car when the accident happened, so does that still count as parking in the no parking zone? What should I do now?

There is no such thing as negligent parking.

The person who hit you is 100% liable.

Poster do you live in any of these states DC, FL, HI, KS, KY, Mass, MI, MN, NJ, NY, ND, PA, or UT? These states have no fault schemes, and they are not all the same.

I live in Illinois...I don't know if it makes any difference...for example comparative negligence?? Any legal help/advise would be greatly appreciated!

You better call a lawyer, insurance companies don't beat the bushes looking to payout more.

Thank you all for the replies...I need more feedback on this case...Any legal or insurance advice would be greatly appreciated.
