Common element or not?

I own a townhouse that had its front wall damaged by a contractor working for the management company. The public adjuster I hired could not service me because they claimed that the damaged wall was a common element, and therefore the sole responsibility of the management company. While in the process of filing suit against the HOA and the management company, I went to the county seat to pull up a condo declaration, and the county told me there was no declaration, because it is not a condo. So I need to know, are the front and rear walls of a townhouse common areas or not?
