Alcohol & Drugs: MIP, MIC, Intoxication College party incident

I have a scenario that I wish to address the community that is based on a real life event that occured a few days ago in a university in the Dallas-Fort Worth area a few days ago.

Names:
A: A Anglo male age 18 from VA. Shares a room with B. Posssess a glass bong and an unknown amount of high grade weed and an array of prescription drugs. And also is wealthy. A fraternity member and officer

B: A Anglo male age 19 from GA. Shares a room with A. Posses a case of Natural light("Nattys") beer and several cans of 4 lokos and titls which he bought from a friend of A, that is age 21 that purchased in B's behalf. He is also wealthy.

C: A Anglo male age 19 from North Texas area. Invited by A to "play beer pong". Sort of wealthy/upper middle class. Has known the A&B for a weeks now and slightly parties with them, but mostly with A and a few fraternity members.

D: A Hispanic male age 19 from Southern texas. Lower class. Invited by B to "play beer pong." Has slightly partyed with A&B in the past; and sort with C just a for a few times.


Scenario:

Around 4:50 pm D arrives at A&B's room to play beer pong and he is greeted by C who is setting up the table to play. The 4 converse for a bit and so. The 4 play about 3 or 4 so games. In between the games, they smoke weed from A's glass bong and also take an array of pescription drugs(Xanax/Paxil) which were from A. A sells to B and C but D takes a half bar of Xanax. Around 7:20 or so, D somehow blacked out in the room. A, B,C leave the room. D managed to leave the room and passed out in the hallway and found by an unidentified female student who called 911. D is transported to a local hospital and awakes the next day not remembering how he collapsed or his arrival at the hospital.

In the opinion of the community, who of out of the 4 would be charged with anything at all?
 
No one could be charged if everyone keeps their big mouth shut.

Race and/or status has nothing to do with any legal outcome.

A, B, & C left the room before D was found.

Nothing can be tied to A, B, or C. Why?

None of them were around when D was discovered.

D could be charged, but probably won't as he was treated at hospital.

The Uni could bring separate charges.
 
If D was under the influence then he could possibly be charged with something, depending upon state laws in Texas.
A could get hosed if the police were to learn that he was selling/providing the pills, but they would still have to find his stash. B and C are in the clear.
I agree that action by the university is what you should be concerned with- this doesn't seem like something the police would spend much time on.
