Depending upon what state you live in and their laws, you should be able to take your ex-wife back to court. Your daughter is old enough that the judge can ask her where she prefers to live and it shows to be in the best interest of your daughter. I am not a lawyer,so I can not be 100% sure of your state laws. I know that is the Texas law. I do believe the age here is 12 yrs. old and the judge will request the child to meet in the chambers and speak with him/her. :angel best of wishes
 
13 in Montana. My son testified in court when he was 10. Just depends on the court.

At sixteen, I would think the judge would draw heavily on what she has to say.

Do you live in the same town/city/ county?
