Mother in KY, Father in NC

The mother forged her ex husbands name on daughters birth certificate. The biological father did not know until recently that it had happened. He wants to get his name on the birth certificate. The mother has lost custody of the child. The child does not want to change her last name. Nothing was done legally with the name change. The mother just changed it when she put the ex husband on the certificate. Can the bio-father just change the fathers name and not her last name? What problem can happen if it is not changed. Since nothing was legally done, in the beginning to change it in the first place?

Was the ex-husband married to the mother when the child was born, or at any time during the pregnancy? no, met after the fact

How did she forge his name??? she just went and put his name on the b/c, they let her in WV without ex's knowledge or bio-father

How old is the child? now 17

Whose name changed? She was born with mother maiden name when she put ex husband on b/c she changed her name to his (she was getting support from both men)

Was the original birth certificate changed? the bio-father had one with maiden name, ex husband with his name, WV says they showed the Ex's birth certificate on file, bio-father would never sign away rights

And who are you in all this??? g/f

bio dad tried to get custody when child was young, mother took off for 8 years, she has used at least 4 different names, hard to catch up with, yes, she did the some of the same to the other two childrens fathers

I'm still confused, but I'll assume that you are the bio-dad's gf. He should consult an attorney about amending the birth certificate, and about the child support.

Since the ex has custody, it seems that he has had an ongoing paternal relationship with the child. As such, it may be difficult to amend the birth certificate. However, if your boyfriend has been paying child support by court order, then he must have been declared the legal father at some point.

This is a muddled mess, and he needs an attorney to help sort it out.

when my son was born the mother put her husbands last name on the certificate. they split up and then got a divorce. well five years later she wanted to get me for child support, so i had a dna test done thru the attorney general. with the dna results showing me as the father i had to get a form off the attorney general site to amend a birth certificate for name change. because i was found to be the father there was a court order to change my sone last name. i sent the form and a notorised ,certified original copy from the court house to austin as the site i got the form from instructed, along with i think 15 dollars and two weeks later i got his new birth certificate. if you get a dna test and a court order for name change he shouldnt have any problems. hope i could help and this was in texas

since you are only the gf, not the mother, this legally doesnt concern you. this is dad's issue to deal with. my advice is for you to stay out of it.
