Do you mean that he threatens to go to court for custody?
If so, he probably will not get primary custody unless he can prove that you are unfit.
Even if you return the money, he can still go to court for visitation rights and possibly joint legal and physical custody.
I wouldn't return the child support, but I don't believe it would be illegal. Once you have the money, it yours. You can do with it what you like.
