Okay well my husband has been paying child support for almost 3 years and the mother hasn't had the child, he is in the custody of my husband, how do we go about getting that money back and also the past 3 years back pay>

One will file a modification if support. I don't know if you will be getting any money back, but the payments should stop or reverse.
