I'm not sure what steps to take first. My ex-husband and I got divorced in 1999 and the divorce decree states that we have shared joint custody with an equal amount of parenting time. It also states there is to be no child support paid to either parent. Since then we both moved to another city and things were still ok until recently. A year and a half ago he moved 3 hours away but said it was only temporarily and he would be moving back. Since then he has joined the Army Reserves and is set to leave in May 2008 (still lives 3 hours away). The problem is that he is neglecting to abide by the divorce decree and my new husband and I have been raising the kids since he moved. He hasn't been spending any time with the kids and he hasn't paid a dime to help raise them since he has been gone. I want him to pay child support now but I cannot afford an attorney. The question I have is do I need to find legal documents to amend the divorce decree or to just modify the child support? The county where the divorce was completed is also 3 hours from me, can I mail the legal documents to the courthouse or do I need to hand deliver them?
