I was dating a lady for 2 months while we were stationed in Okinawa. A few months after we went our separate ways she told me she was pregnant. She told me she would be fine without child support but I insisted I pay it. We decided on $420 a month in which I have been faithfully paying to date since April 2005. I have it set up to where the money is taken out of my account and direct deposited into her account. Our daughter was born March 2005. Since then, she has remarried and had another child by her current husband. I asked her if her husband was willing to adopt our daughter since I have never been in her life and she told me they could not afford it financially as she is not working. So I left it at that.

About 4 months ago I received an email from her stating she wanted me to add our daughter to my military insurance so she can get her shots for preschool. I declined because the a) the child is not in my life and b) the $420 should cover the costs of any immunizations she would need.

One week ago I received an email from the GA DA office stating it was a Summons and Rule, Petition for Child Support and Acknowledgement. It also states that a ruling of Child Support will be made for me to support my child??

My questions are is this a legitimate email and should I respond? And why would I receive this if I am already paying child support - I can prove it through direct deposits into her account from my checks. I currenty am stationed in NV and she resides in Savannah, GA.

Why are you not in the childs life? You do realize you can take mom to court for visitations and you probably will be awarded something. Because you do not see the child that has nothing to do with your responsibility to support.

You should contact an attorney because it appears mom has either applied for child support through the local DA's office, or she was on government assistance. Since you pay mom under the table and not from a court agreement, no actual child support order exists. You need to make sure your past payments to her are seen as child support and not gifts, so that mom cannot go back and sue you for back support, or that the state does not try to get retro child support from you.
