He does not have to pay anything until the courts tells him too. Has either one filed for divorce? Before an order of child support is entered, if he pays mom anything he needs to note on the check that it is child support so mom cannot go back and claim he did not pay.
It is unlikely he will pay child support at full guidelines and day care. He might be ordered to pay a portion of day care, he really should see an attorney. Its perfectly reasonable for dad to pay for half of day care and mom pay the other half.
In some jurisdictions day care may not be ordered outside of child support but it is pretty normal for the parents to split it. Dad needs an attorney it sounds like so he does not get hosed.
