Child Support after alleged adoption

Here's the story:

My husband was contacted in January of 2006 by an ex-girlfriend stating that she had given birth to a child and it could possibly be his. My husband was unaware of such but we tried to ahndle the matter. The childs mother applied for government assistance and so the paternity and other relief notice was sent to my husband at that time. Sadly the list of possible fathers was extensive. My husband had his order to go for the paternity testing and was advised at said time that he would be put in jail if he failed to appear. A few weeks later we were contacted by the child's mother that she wanted to drop the suit because one of the alleged fathers wanted to adopt the child, as he was already excluded as biological father but wanted to raise her anyway. My husband agreed to that because we were expecting our first child. The mother petitioned him with an affidavit of non-paternity pending the adoption. She stated it was the only way the court would allow the adoption with a pending child support case. After the affidavit was filed we did not hear anything further until June 2nd of 2008. We received all new paperwork and the childs last name was changed to the man's name that allegedly adopted her. Since then, my husband had the paternity test done and discovered that he is the biological father. He has met with the mother and child since then to try and determine what she needs or expects. The mother simply states that she wants nothing from my husband and that the child only knows the other man as her father and intends to keep it that way. Now my husband is very upset and concerned. He is upset that he may be forced to pay back child support when he was led to believe that the child was adopted. Is it possible that the child was legally adopted and the child's mother is omitting that info.? If so, how do we go about finding out. We are in the process of meeting with an attorney, but we are curious if we may be able to get some answers prior to the meeting. All we know is the child's name was changed after we were told of a pending adoption. We were advised by said atty. that the only way her would have been changed is with a legal adoption. Is that true? Sorry the thread is so long, we are just very confused. Is my husband still legally responsible for the child if it shows that she was adopted? Please help and thanks for listening.

Your husband still owed back support if mom was on government assistance. If the child was adopted then usually future support is terminated.
