My jurisdiction is: California

My ex-wife has custody of my two boys in NC. We are in the process of drafting a modification to our divorce decree. My child support payments has been increased which i don't have a problem with. I'm in the military and my boys are under my insurance (Tricare). In the past tricare pays 60pecent of all bills and my ex-wife pays the difference. In the modified decree she wants me to pay half of any bills she recieves for the boys. Is that legal?

This is not a matter of law; this is a matter of what your divorce decree says. There is no law in any state that dictates which parent is responsible for what bills. There is nothing illegal in what she suggests; whether this is what will be required of you or not is a matter for the judge to decide.

Tks for the response. The original decree only states that i will maintain medical and dental insurance. Do i have a way or chance to fight this? I have already agreed to the child support increase but i have yet signed the new decree or agreed with paying half the medical bills.

Sorry. I'm not a family law expert. I know a lot about insurance law so was able to advise you that there is no law prohibiting what she is asking for; the chances that it will or will not be modified into a requirement are outside my sphere of knowledge.
