So, here is the deal. I just recentley got divorced in July. I filed for Joint Custody with my ex husband. In the parenting plan it states that my ex husband will have the children every other weekend. At all other times they will be with me. The judge of course signed off on this. Well, now my ex husband is being a jerk and says that I cannot put him on a schedule and that he will see the kids when he sees them. This is a huge frustration for me because I am now forced to find a babysitter to watch my kids if I want to make plans or cannot go at all. How can he just not obey what is in the legal documents signed by the judge? Is there any way that he HAS to abide by these rules? And is there repurcussion if he does not go by the rules? I am so frustrated and need help.

He actually does not have to see the children on his time. Is he the non custodial parent? You cannot force the non custodial parent to use his visits. However all you can do is document it and if he is getting a parenting time discount on child support, you can possibly go back to court and ask for the child support to be adjusted, in the future. Just keep track of everything on a calendar to cover yourself. Has he actually missed a visit yet?
 
Unfortunatley that is what I thought.....Ya, he has actually missed all his visits...He is supposed to have the kids every other weekend. He has not had them for a weekend at all. I guess that I will start documenting everything and see what happens. If I have to go back to court, then so be it.
