My boyfriend is trying to have his divorce finalized. They have a 9 month old son together. He has a felony on his record that is ten years old categorized as entrapment ( long story ). Anyways the mother is threatning to bring this up in court as a way to take custody. Can something this old affect his custody? I was under the impression that you can only lose custody if you are proven to be an un-fit parent, which he is not. He is extremely worried about this and allowing the mother to walk all over him from it. So any answers would be appreciated! Thank you
 
Well because the child is an infant it is highly unlikely he will get custody, but he can certainly ask for joint. A felony that is 10 yrs old probably will not matter. Mom apparantly didn't care he had it since she had a baby with him.

I would stop listening to mom and fight for as much visitation as possible.
