I filed bankruptcy in 2005. One of the creditors included in the BK resubmited the SAME debt to my credit report in June 2009. Can I dispute this listing? Is there a statute of limitations?
Depends on how it is read -- " Included in Bk" or "charged off"... What does it say? Just because you file bk does not mean the creditors have to remove it from the credit report--
whether it says 'charged off' has nothing to do with bankruptcy
If the debt was included in the bankruptcy under chp 7, then the debt would have either been paid with your assets or discharged (or forgiven). In any case, you should have evidence of this that you can send to the credit agency.
