Hello, A friend was contacted recently with an offer for a program to learn english. She was told the call was being recorded and proceded to agree to purchase the program. The woman told my friend that she would call back at a later date to give her the information to fill out and send a money order. My friend decided against the purchase and the company has been calling her telling her that she should reconsider her decision because after all they have her on tape agreeing to the transaction. Does she really have to go ahead with the purchase or does she have the legal right to change her mind. Thank You.
The telephone scammer could have 500 recordings, it won't matter.
The first thing they did wrong, was not seeking her consent to record the call.
California's wiretapping law is a "two-party consent" law.
California makes it a crime to record or eavesdrop on any confidential communication, including a private conversation or telephone call, without the consent of all parties to the conversation.

But, forget that, as it doesn't matter anyway.
It just illustrates how stupid these scammers are.
Tell your friend to block the caller, or ignore them.
She is under no obligation to pay them so much as one, fat nickel.
There was never a contract.
A promise to pay might have been made.
But, promises alone, don't contracts make.
Your friend doesn't have to do one darn thing.
Besides the silliness of their claim, she probably didn't understand what she was being asked, because she doesn't speak English well.
