I have been divorced for three years, separated for close to four. I have two children 10 and 9. My ex wife has physical custody of the children. They live over 60 miles away and I make the drive every week to bring them to my home and spend time with them.
My 9 year old son has severe disciplinary problems both at his mother's home and school. I've never had any extraordinary discipline issues with him during my parenting time. At my house he listens, keeps an orderly room, does his homework and performs house chores without being asked. At his mother's house they can't even get him to eat with a fork and knife.
My ex wife has been called to the school several times on disciplinary issues and even Child Services was called to start an investigation for neglect on her part. The investigation showed nothing was going on.
The problems at school have escalated because my son has twice participated in behavior that the school classified as harassment. The first incident involved him giving a girl a kiss. The second incident involved him telling a girl that he wanted to have sex with her. The school has been clear that the next incident of this nature will involve authorities.
My ex wife has grounded and talked to him, but he is disrespectful and she is unable to discipline him - he will laugh if she tries to be serious, etc. I have grounded and had stern talks about what is expected of him, in my case he is always repentant.
I want to have the Custody modified so he can come live with me and transfer to a different school. I believe with the current situation, it would be in his best interest to live with the one parent he shows an ounce of respect for, before it's too late and he ends up arrested and in a sex offender registry at age 10.
Will this be possible? What kind of evidence do I need? Should I have legal representation? Will the fact that my girlfriend lives with me (for the last 2 years) be an issue with the court? She listens more to her than he does to his own mother. She is the one who was able to teach him multiplication and get him to eat with a fork and knife.
