My ex and I have a 3 year old child. Neither has court order custody. I live in Texas and he lives in Kansas. I am a little frightened to let him go with his father because I am scared he won't bring him back. Can he just come down here and take him and there is nothing I can do about it? Until we get it in writing
 
Go to court, establish paternity and file to get child support, custody and visitation sorted out.

A court order protects ALL of you.
 
What if I don't have the money to get a lawyer..


You can easily file pro se (representing yourself). Call the court-house where you live, and ask which forms are needed. They cannot tell you how to fill them out, but they can at least tell you what's needed.
