car dealer problem

I wasn't sure where to post this since my warranty has nothing to do with this problem anymore but here's the story:

I had to bring my car back to the place I bought it from to get a broken water gaskets fixed, a week passed and I called to see how it was going they told me it was a transmission problem, and that they were working on it, 2 more weeks passed and I called back and I found out that the warranty wouldn't cover it because they took the transmission apart without calling it in first, now I been calling them all week and they are avoiding my calls, I don't know what else to do its been a month now.
What should I do?
And is this even legal??

Be patient and work with them...........see what they are offering about the repair and in replacing your warrantee..........If they keep delaying per your PM then call their corporate office and eventually sue if they don't respond.
