I am charged of trespass 3rd degree felony. I am a legal resident and lived in the US for 30 years with no other criminal or other legal records. I might enter a PTI program for one year. 1st question: why is it considered 3rd degree felony if only a trespass? can i travel overseas while completing my PTI? I was told that laws around PTI have recently changed: The offender no longer has to admit guilt in order to enter the program. Also, the new law will help in the future when I apply for citizenship (and avoid the possibility of being deported). a) is this true? b) if the law changes again, will I be therefore considered guilty then and will face possible deportation? In advance, thank you.

Before you do anything, you should consult with your criminal defense attorney.
You might also review the terms if your bail or bond agreement.
If you posted bail through a bonding agent, you'd be smart to ask them.
In most cases the answer is no.
