I am charged of trespass 3rd degree felony. I am a legal resident and lived in the US for 30 years with no other criminal or other legal records. I might enter a PTI program for one year. 1st question: why is it considered 3rd degree felony if only a trespass? can i travel overseas while completing my PTI? I was told that laws around PTI have recently changed: The offender no longer has to admit guilt in order to enter the program. Also, the new law will help in the future when I apply for citizenship (and avoid the possibility of being deported). a) is this true? b) if the law changes again, will I be therefore considered guilty then and will face possible deportation?
