can i sue my ex for false statement she made

when i took my ex wife to court for joint custody, in her affidavit she wrote that i threatened her with a weapon which never happened but that never came up during our divorce. She also made other untrue statement as well which i do not want to get to personal on here.? Can i sue her and what would i need to prove in order to win the case?

What damages have you suffered?

It's hard to win defamation cases & usually damages awarded are small. Also the cost to sue can exceed what you receive in damages.

Of course you can initiate a lawsuit.

But, you won't prevail.

Why??????

Because court proceedings and all filings are protected speech, meaning litigants are free to say most anything in their pleadings.

It's up to the court to finally determine the admissibility of said pleadings and further evidence.
