Can I Sue His Mistress

My husband and I have been seperated for 3 months now, he has been living in a motel with his mistress, he has not asked for a divorce, can I sue his mistress for mental distress or anything?

Probably not. Your husband is also responsible for the affair-nobody forced him into it.

In the olden days you might have been able to sue on grounds on Alienation of Affection but that does not really exist anymore. It takes two to tango.
