I have sole legal custody over my 4 year old son. His mother has visitation. I don't want to sound paranoid over the big deal everyone is making about the H1N1 virus but here's what I learned today:
My ex texted me to say that the school where she works is shut down because of a confirmed case of the H1N1 virus. (A teacher is sick.) This weekend is her weekend with our son and I've asked her to please switch weekends or get tested or something because he's only 4 and I would hate for him to get sick.
I have several documented instances where my child will return home from her house with severe diarrhea, a cold, a cough or some sort of ailment. I know his hygiene is not something she takes good care to maintain while he is with her. I'm genuinely worried and I have NEVER not kept to the visitation schedule I have with her. She's accusing me of keeping him from her and will not go to a doctor or wait it out to see if she's ok.
Am I being paranoid? I realize she could file contempt charges and at this point, I'd be willing to face a judge and tell him why I did this. But if I am truly concerned for my son's welfare, would keeping him for a night or two during her time be justified?
