My ex husband and I have joint custody of our 2 boys. He is domiciliary parent and I have visitation on holidays and summer breaks because I live out of state. I pay child support to him. I speak to the boys at least 2 or 3 times a week. I recently found out that my ex was arrested and put in jail. When this happened he called my mother (who lives in the same town) to make sure that the boys were picked up and taken care of while he was in jail.
My mother called me today and informed me that while my ex is in jail that he has signed custody over to his father and step mother. His father and step mother contacted my mother today to let her know that they will be picking the boys up from her house on Friday afternoon. She is afraid that if she hands them over to them that we won't be able to see them. Our families do not get along. I am aware that if they go with their grandfather that I will not be able to talk to them or see them regardless of whether or not the boys want to see me or talk to me. My question is, can my ex do this without my consent? Neither of the boys want to live with their grandfather. They have both expressed a desire to come live with me if they can not remain with their father. Can he just give them to his family when I have joint custody of them and want them to live with me? Is this legal to not even ask me and just sign them over to them? Any advice as to what my legal rights are would be helpful.
